1. **INTRODUCTION**

This report concerning the privacy policies of personal data by MO-TEC SRL aims to accurately describe the management of personal data processing of portal users. The information does not apply to other websites that may be accessible through our links.

**MAIN DEFINITIONS**

- User: The individual who uses the services of this website, even just for web browsing (coincides with the data subject).

- Data Subject: The natural person to whom the Personal Data refers.

- Data Controller: The natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

- This Application or Platform or Website: The hardware or software tool by which the Personal Data of Users is collected.

MO-TEC SRL (hereinafter also referred to as the "Organization"), with registered office in Viale IV Novembre 8, 42121 Reggio Emilia (RE), VAT: 02990220358, as Data Controller of Your personal data, pursuant to Legislative Decree 196/03 and Regulation (EU) 679/2016, regarding "the protection of individuals with regard to the processing of personal data and on the free movement of such data", hereby informs you that the processing of your data will be based on the principles of fairness, lawfulness, transparency, and the protection of your privacy and rights.

3. **DATA PROTECTION OFFICER**

The figure of the Data Protection Officer (DPO) is not provided for within this Organization as it is not necessary according to the Regulation itself.

4. **PURPOSES OF DATA PROCESSING**

The purpose of our website is to allow you to request information about our products and/or services through the contact addresses and numbers provided on the "CONTACT US" page. The optional, explicit, and voluntary sending of emails to the addresses indicated on the website entails the subsequent acquisition of personal data; we therefore invite our users, in requests for services or inquiries, not to send names or other personal data of third parties that are not strictly necessary, nor special and/or judicial data pursuant to articles 9 and 10 of Regulation (EU) 679/2016.

5. **LEGAL BASIS AND LAWFULNESS OF PROCESSING**

In reference to the lawfulness of the processing identified, the undersigned specifies the legal bases on which they are based: For the purposes set out in Point 4 of this statement, the processing of your personal data is possible only and exclusively with your specific consent (art. 6, paragraph 1, letter a) of the Regulation). The explicit and voluntary sending of emails to the email addresses inserted on this website is considered as natural consent.

6. **PROCESSING METHODS**

Each processing operation takes place through the adoption of security measures, technical and organizational, appropriate to the processing itself as indicated in Article 32 of the Regulation. All data is processed both with the help of computer systems and, where appropriate, through specific paper databases. We use a wide range of advanced security technologies and procedures to help protect personal data against the risks described above.

7. **RECIPIENTS OF PROCESSED PERSONAL DATA**

The recipients of the personal data for the purposes outlined above will be exclusively the Controllers of the undersigned Organization, the employees, and the direct collaborators of the Organization itself for the sole purpose of providing the service requested by the user, unless the communication is imposed by legal obligations or is strictly necessary for the fulfillment of user requests.

8. **TRANSFER OF DATA TO A THIRD COUNTRY**

No transfer of your data to a third country or to an international organization outside the European Union is foreseen (articles 44-49 of the Regulation). The data center where the data resides is located in Italy.

9. **PERIOD OF RETENTION OF PERSONAL DATA**

Personal data is not kept beyond the time necessary to achieve the specific data processing purposes described herein, unless longer or shorter retention periods are provided for under the applicable laws.

For the purpose of processing indicated in Point 4. of this statement, your personal data will be kept for the duration of the requested service or the resulting contractual relationship. In the event that a formal contractual relationship is established from this contact, your data will be kept as per legal and regulatory obligations in accordance with the maintenance of accounting, tax, and administrative records, and more generally of employment relationships.

10. **RIGHTS OF DATA SUBJECTS**

You have the right to request from the Data Controller access, erasure, communication, updating, rectification, objection to processing, integration, limitation, portability, notification of the breach of your personal data, and in general, you can exercise all the rights provided for in articles 13 and following of Regulation (EU) 679/2016.
